Welcome to Izzy on the Eyes (referred to as “we,” “us,” or “our”), operating at https://music.izzyontheeyes.com. These Terms of Service govern your access to and use of our website, services, and products.

By using our website, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our services.

1. Business Entity & Jurisdiction

“Izzy on the Eyes” is based in British Columbia, Canada. All transactions are governed by the laws of the Province of British Columbia and applicable federal laws of Canada.

2. Pricing & Currency

All prices on this site are listed in Canadian Dollars (CAD) unless otherwise stated. Taxes may be applied where required by provincial or federal law.

3. Products and Services

We offer digital music downloads and custom-made audio products. All sales of digital goods are final and non-refundable. If there is a technical issue with your download, please contact us at suppor(at)izzyontheeyes.com for assistance.

4. Payment & Billing

We accept payments through trusted third-party processors such as PayPal and Stripe. By submitting payment information, you confirm that you are authorized to use the chosen method and that all billing information is accurate.

5. Intellectual Property

All content on this site, including original music, design, graphics, and branding, is the intellectual property of Izzy on the Eyes unless otherwise indicated. Unauthorized use, duplication, or distribution is prohibited.

6. User Conduct

By using this site, you agree not to:

Violate any local, provincial, or federal laws
Interfere with the website’s security or functionality
Use the content for unauthorized or commercial purposes

7. Privacy

Please refer to our Privacy Policy for information on how we collect, use, and protect your personal information in compliance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and other international standards including GDPR and CCPA where applicable.

8. Refunds & Returns

All digital products are provided on a final sale basis. Digital music downloads, albums, and custom music orders are non-refundable, non-returnable, and non-exchangeable.

Because digital content is delivered electronically and access is provided shortly after purchase, refunds, returns, cancellations, or chargebacks are not permitted once access has been made available.

In the event that a customer experiences a technical issue that prevents access to the purchased content, we will make reasonable efforts to assist by resolving the technical issue or restoring access. Such assistance is provided as technical support only and does not entitle the customer to a refund, return, or cancellation.

This policy does not limit any mandatory consumer rights provided under applicable law.

9. Music License and Permitted Use

9.1 Ownership of Content

All music, audio recordings, compositions, and related content made available through Izzy on the Eyes are protected by copyright and remain the exclusive property of Izzy on the Eyes or its licensors, unless otherwise expressly agreed in writing.

Purchasing a digital music product does not transfer ownership of copyright or intellectual property rights.

9.2 License for Non-Custom (Standard) Music Purchases

When you purchase a non-custom music track, album, or digital audio product, you are granted a limited, non-exclusive, non-transferable, non-sublicensable license to download and use the content solely for personal, non-commercial listening purposes.

This license permits:

Personal listening on your own devices
Creation of personal backup copies for your own use

This license does not permit:

Resale, redistribution, sharing, or public posting
Uploading to streaming platforms, social media, or file-sharing services
Use in videos, performances, broadcasts, public venues, or classes
Commercial, promotional, monetized, or business-related use
Modification, remixing, synchronization, or creation of derivative works

9.3 License for Custom Music Purchases

For custom or commissioned music created specifically for a customer, the purchase grants a limited, non-exclusive license for personal or internal use only, unless a broader license is expressly agreed in writing.

Unless otherwise stated:

Izzy on the Eyes retains all copyright and intellectual property rights
Custom music may not be resold, redistributed, sublicensed, or publicly exploited
Commercial use, public performance, distribution, or synchronization is not permitted without an additional license

Any expanded rights must be documented through a separate written agreement.

9.4 Commercial Licensing and Upsell Option

If you wish to use any purchased music for:

Commercial purposes
Social media, video, advertising, or marketing
Public performances, classes, events, or broadcasts
Synchronization with video or other media
Monetized or business-related activities

You must obtain a separate commercial license prior to such use.

9.5 Canadian and International Legal Compliance

These license terms are intended to comply with applicable Canadian copyright laws and international intellectual property standards. Nothing in this section limits any rights that cannot be waived under applicable law.

9.6 GDPR and Data Protection

Personal data collected in connection with music purchases is processed solely for order fulfillment, licensing administration, customer support, and legal compliance, in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

10. Modifications

We reserve the right to modify these Terms at any time. Updates will be posted on this page with a revised effective date. Continued use of the site after changes constitutes acceptance.
